EU New Regulation on Silver-Based Antimicrobial Agents – Detailed Information (Effective March 2026)

1. Legal Basis & Effective Date

Core Regulation: EU Commission Regulation (EU) 2024/2564 amending CLP, approved in October 2024 and formally applicable as of March 1, 2026.

Scientific Basis: The EU Scientific Committee on Consumer Safety (SCCS) classifies silver (including nanosilver, microsilver, bulk silver) as a CMR Category 2 (reproductive toxicity) substance.

Scope: All consumer products placed on the EU market, including textiles, apparel, baby products, cosmetics, household goods, etc.

2. Ban & Restriction for Textiles & Consumer Products (Effective March 1, 2026)

2.1 Full ban on silver‑based antimicrobials

Silver ions and silver‑based antimicrobial treatments are completely prohibited in:

Direct skin‑contact clothing: underwear, bras, T‑shirts, shirts, socks, sleepwear, loungewear, etc.

Baby products for under 2 years: baby clothes, rompers, bibs, diapers, comfort blankets, bedding, pacifier clips, teething products, etc.

Non‑washable products: leather goods, footwear, hats, gloves, scarves, nonwovens, disposable products, hard surface coatings, etc.

Outdoor products: outdoor jackets, quick‑dry apparel, tents, sleeping bags, hiking gear, outdoor footwear, sun protection clothing, etc.

2.2 Narrow exceptions

Allowed only for non‑skin‑contact industrial / technical textiles and packaging materials, subject to specific authorization under the EU Biocidal Products Regulation (BPR).

Any product treated with silver‑based antimicrobials must be clearly labeled:

"Contains silver‑based antimicrobial agent. For non‑skin‑contact use only."

3. Cosmetics & Personal Care (Effective May 1, 2026)

Based on EU Regulation (EU) 2026/78 amending Cosmetics Regulation (EC) No 1223/2009:

3.1 Full ban (Annex II)

Nanosilver (1 nm < particle size ≤ 100 nm): banned in all cosmetics.

Bulk silver (particle size ≥ 1 mm): banned in all cosmetics.

3.2 Strict concentration limits (Annex III / IV)

Microsilver (100 nm < particle size < 1 mm):

Toothpaste, mouthwash: ≤ 0.05%

Lipstick, eye shadow: ≤ 0.2% (colorant only, not for antimicrobial use)

Leave‑on cosmetics (creams, body lotions): ≤ 0.3%

Rinse‑off cosmetics (shampoo, body wash): ≤ 0.2%

Prohibited in: cosmetics for children under 2, cosmetics for pregnant women, spray products.

4. Compliance & Enforcement

Market access: Non‑compliant products are banned from the EU market; existing non‑compliant products must be recalled and removed from shelves.

Testing requirements:

Textiles / apparel: silver migration ≤ 0.1 μg/cm²

Cosmetics: particle size analysis + concentration test, with clear ingredient labeling.

Penalties:

Fines of 1%–10% of turnover

Product seizure

Blacklisting and potential suspension of EU market access

Criminal liability in serious cases.

5. Industry Impact & Approved Alternatives

5.1 Affected sectors

Textile & apparel: innerwear, babywear, sportswear, outdoor brands must reformulate.

Baby products: silver antimicrobials banned for under 2s.

Cosmetics: nanosilver formulations phased out.

5.2 EU‑compliant alternatives

Textiles: quaternary ammonium compounds, chitosan, PHMG, zinc/copper ions, TiO₂ photocatalysis.

Cosmetics: phenoxyethanol, ethylhexylglycerin, plant extracts (rosemary, tea tree), etc.

Baby products: physical antimicrobial structures, silver‑free formulations.

6. Compliance Timeline 2026

Before March 1: Complete formulation and production adjustment.

March 1 onward: Only compliant products allowed in the EU; strict customs and market surveillance.

May 1 onward: Cosmetics restrictions fully enforced.
